By accessing this website, contacting me, booking photography services, purchasing products, or participating in a photography experience, you agree to the terms outlined below.
1. Photography Services
Erica Loeks Photography provides professional photography services, including portrait, senior, personal branding, commercial, lifestyle, and other photography experiences described on this website.
Specific services, pricing, deliverables, session details, and other terms may vary by offering and will be communicated before booking. A signed agreement, contract, or other written confirmation may contain additional terms specific to your photography experience.
2. Booking and Payment
A session date is not considered officially reserved until the required retainer, deposit, or session fee has been received and any required agreement has been completed.
All pricing and payment requirements will be communicated at the time of booking.
Unless otherwise stated in writing, photography session fees cover the photographer's time and creative services and do not necessarily include photographs, digital files, prints, albums, or other products.
Additional photographs, digital files, prints, albums, artwork, and other products may be purchased separately according to the pricing in effect for your session.
3. Pricing and Product Purchases
Prices are subject to change. The applicable pricing for your photography experience will be communicated or provided at the time of booking.
Photography products are custom-produced for each client and may not be eligible for cancellation, return, or exchange once an order has been placed into production, except where required by applicable law.
Because photography is a custom service, refunds are not guaranteed once services have been performed or custom products have been ordered.
4. Cancellations and Rescheduling
If you need to cancel or reschedule your session, please provide notice as soon as possible.
Retainers and session fees may be non-refundable, particularly when a date has been reserved exclusively for you.
Rescheduling is subject to availability and may be subject to additional fees or other conditions communicated at the time of booking.
Erica Loeks Photography reserves the right to reschedule a session due to illness, emergency, unsafe weather conditions, equipment failure, or circumstances beyond reasonable control.
5. Client Responsibilities
Clients are responsible for providing accurate information, arriving on time, communicating scheduling needs, and following reasonable instructions during the photography experience.
Clients are also responsible for ensuring that children and other individuals participating in a session are appropriately supervised.
Please communicate any relevant accessibility, safety, or other needs before your session whenever possible so reasonable accommodations can be considered.
6. Artistic Style and Creative Judgment
Photography is a creative service. By booking Erica Loeks Photography, you acknowledge that you are familiar with and appreciate the photographer's artistic style.
The photographer retains creative discretion regarding composition, posing, lighting, locations, editing, image selection, and final artistic presentation.
Specific photographs, poses, backgrounds, locations, or other creative results cannot be guaranteed.
The photographer is not obligated to provide every image captured during a session. Final galleries and delivered images are selected according to the photographer's professional judgment and the products purchased.
7. Image Editing
Images may be professionally edited according to the photographer's established style.
Basic editing may include adjustments to exposure, color, contrast, cropping, and other artistic elements.
Extensive retouching or requests for significant alterations may be subject to additional fees and are not guaranteed.
8. Copyright
All photographs created by Erica Loeks Photography are protected by United States copyright law and remain the intellectual property of the photographer unless otherwise agreed to in writing.
Purchasing photographs or digital files does not transfer copyright ownership.
Clients receive the personal or commercial usage rights specifically described in their agreement or purchase terms.
Photographs may not be sold, licensed, altered, commercially reproduced, or otherwise used outside the granted usage rights without written permission.
9. Personal Use of Digital Images
When digital files are purchased for personal use, clients may print and share those images for personal, non-commercial purposes.
Clients may not apply filters, materially alter the photographs, remove watermarks or identifying information, or use the images for commercial purposes without written permission.
10. Photographer's Use of Images
With appropriate client permission, Erica Loeks Photography may display selected photographs in portfolios, on the website, social media, advertising, studio samples, publications, competitions, or other promotional materials.
Clients may withdraw permission for future promotional use by contacting the photographer. Withdrawal does not require the photographer to recall or remove materials that have already been printed, published, distributed, or otherwise created before the withdrawal.
11. Client Privacy
Personal information provided through this website or during the photography experience will be handled according to the Erica Loeks Photography Privacy Policy.
Client galleries and photographs are intended to be accessed only by the client and individuals with whom the client chooses to share them, subject to the security and privacy practices of the gallery or technology platform being used.
12. Website Content
All content on this website, including photographs, text, graphics, logos, branding, design, and other materials, is owned by or licensed to Erica Loeks Photography unless otherwise stated.
Website content may not be copied, reproduced, modified, distributed, published, or used commercially without prior written permission.
13. Third-Party Websites and Services
This website may contain links to third-party websites, products, or services.
Erica Loeks Photography is not responsible for the content, privacy practices, availability, security, or policies of third-party websites or services.
Your use of third-party services is subject to the terms and policies of those providers.
14. Limitation of Liability
While reasonable care is taken to provide professional photography services and protect client photographs, Erica Loeks Photography cannot guarantee against circumstances beyond reasonable control, including equipment malfunction, memory-card failure, data loss, illness, injury, severe weather, venue restrictions, or other unforeseen circumstances.
In the unlikely event that photographs are lost or damaged due to circumstances within the photographer's control, liability will be limited to the amount paid by the client for the affected photography services, to the extent permitted by law.
15. Force Majeure
Neither the client nor Erica Loeks Photography will be considered in breach of an agreement when performance is prevented or substantially delayed by circumstances beyond reasonable control, including natural disasters, severe weather, illness, government restrictions, emergencies, acts of God, or other unforeseeable events.
The parties will make reasonable efforts to reschedule affected services when possible.
16. Changes to Services and Terms
Erica Loeks Photography reserves the right to modify services, pricing, website content, and these Terms of Service at any time.
Changes to these Terms will be posted on this page with an updated "Last Updated" date.
Terms specific to an individual photography booking are governed by the agreement provided to and accepted by the client for that booking.
17. Governing Law
These Terms of Service are governed by the laws of the State of Minnesota, without regard to
conflict-of-law principles.
Any dispute arising from these Terms or from services provided by Erica Loeks Photography will be handled in accordance with applicable Minnesota law.
